Based in Charlotte, North Carolina, Rick McDermott founded McDermott IP Law in October 2018 after practicing IP law at Alston & Bird LLP and its predecessor firm Bell Seltzer Park & Gibson PA for over 24 years. Rick has represented clients both in the Carolinas and across the country, ranging from large multi-national corporations, to start-ups and spin-offs, including both for profit and non-profit entities.

In 2014, Charlotte Magazine honored Rick as Charlottean of the Year for his volunteer work in the community. In addition to assisting his clients with their IP issues, Rick is passionate about giving back to the community and assisting non-profits with their legal issues. Rick currently serves as chair of the board of trustees of the Greater Carolinas Chapter of the National Multiple Sclerosis Society, as a member of the board and executive committee of the Community Building Initiative, and as a member of the Alexis de Tocqueville Cabinet of the United Way of the Central Carolinas. Rick has served on the boards of Equality North Carolina, The Relatives, Charlotte Center for Legal Advocacy, Marquette University Alumni Association, the Dean’s Advisory Council for the Marquette University College of Engineering, the Charlotte Children’s Choir, and the Charlotte City Club.

Are you protecting your business’s inventions? I assist clients in assessing the patentability of their inventions, drafting, filing, and prosecuting patent applications, analyzing competitive patents and patent portfolios, conducting freedom to operate investigations, and analyzing and providing opinions related to issues of patent infringement and validity.
Are you protecting your business’s brands? I assist clients in assessing the marks (word marks and/or design marks) they use to identify the source of their goods and services and their ability to use and register those marks. I also assist clients with registering their marks with the U.S. Patent and Trademark Office, enforcing their marks against confusingly similarly marks, and opposing and cancelling conflicting marks
Have you created something that is worthy of copyright protection? I assist clients in assessing their artistic creations and business materials, such as marketing materials, brochures, websites, manuals, architectural plans and drawings, musical compositions, artwork, etc., for copyrightability and registering such creations and materials with the Library of Congress.
Are you protecting your business’s trade secrets properly? I assist clients in assessing potential trade secrets and their processes and procedures for protecting such trade secrets. I also assist clients by reviewing their agreements with employees and vendors relating to invention disclosures and ownership and the protection of trade secrets and other confidential information.
Your business’s intellectual property can often bring value through licensing. I assist clients in assessing the value of their IP and the potential for licensing such IP. I also assist clients in contacting potential licensees and drafting and negotiating such licenses. If you’re interested in licensing IP from someone else, I can assist you with that process as well.
Unfortunately, sometimes litigation involving IP is inavoidable. Whether my client believe’s someone else is infringing on or misappropriating their IP or my client has been accused of infringing or misappropriating someone else’s IP, I can assist in evaluating potential litigation, as well as representing a client in such litigation, including as lead counsel, co-counsel, or local counsel. I have experience in a number of U.S. district courts as well as the International Trade Commission.
